An Australian Defamation court case said it was published where read, so, so far it is only influencial precedent, not binding, but most courts would follow the precedent.

The data is stored on American servers, so you could see it either way. If it was published where read, the government would not need a warrant to invade information. They could simply do it outside the country (they probably do if you're right).

Actually, it is deemed that things on the internet are published where they are read... so it is not really American ground... but other than that i agree with you... except for the American part.
